1. Acceptance of Terms

By texting or sending a business card photo to +1 (205) 896-2511, you accept these Terms of Service. If you do not agree, do not use the service.

2. Program Description

CardCanner is a user-initiated SMS/MMS service that converts photos of physical business cards into digital contact records and sends the result back by SMS/MMS.

3. SMS/MMS Program Terms

CardCanner is a user-initiated SMS/MMS service. You opt in by texting a message or sending a business card photo to +1 (205) 896-2511. You may receive SMS/MMS messages from CardCanner in response to messages or photos you send us. Message frequency varies and depends on your activity; typically, CardCanner sends one or more replies for each card photo or request you send. Message and data rates may apply. Reply STOP to opt out. Reply HELP for help. Reply START to resume messages. Consent is not a condition of purchase.

4. Eligibility

You must be at least 18 years old and a resident of the United States to use CardCanner. By using the service, you represent and warrant that you meet these requirements. CardCanner is currently available to US residents only.

5. Message Frequency

Message frequency varies. CardCanner sends SMS/MMS messages in response to the business card photos, commands, or support requests you send us, and frequency depends on your activity. Typically, you receive one or more replies for each card photo or request you send.

6. Charges

Message and data rates may apply. Standard messaging and data rates charged by your mobile carrier may apply to messages you send and receive through CardCanner. CardCanner does not charge per message at the free tier. Check with your carrier for details on your messaging plan.

7. Opt-Out, Help, and Resume

Reply STOP to opt out. After you reply STOP, CardCanner will stop sending SMS/MMS messages except for legally required or carrier-required confirmations. Reply START to resume messages. Reply HELP for help.

We do not sell, rent, or share SMS/MMS opt-in consent with anyone.

After opting out, your scanned contacts remain on your phone. Your stored data remains in our system until you request deletion. Text START at any time to resume using CardCanner.

8. Free Tier and Usage Limits

CardCanner provides 50 card scans per calendar month at no charge. If you exceed the free limit, CardCanner will still deliver your contact record. Replies above the free limit may include an upgrade prompt. The free tier resets on the first day of each calendar month.

CardCanner never blocks a card result to enforce a paywall. You always receive the processed contact before any upgrade notice is shown.

9. Acceptable Use

You agree not to misuse the CardCanner service. Prohibited conduct includes:

• Submitting automated, scripted, or bulk requests to our number.
• Scraping, harvesting, or systematically extracting data from CardCanner.
• Submitting business cards belonging to individuals you have no good-faith reason to contact.
• Using the service to harass, defraud, stalk, or surveil any person.
• Submitting content that is illegal, obscene, threatening, or otherwise prohibited under United States law.
• Attempting to circumvent usage limits or access controls.

Violations may result in suspension or permanent termination of your access to CardCanner.

10. Service Availability

CardCanner is provided on a best-effort basis. We do not guarantee uninterrupted availability, uptime, or error-free operation. We may modify, suspend, or discontinue the service at any time without notice. We are not liable for any interruption or unavailability of the service.

11. Intellectual Property

You retain all rights to the images and content you submit to CardCanner. By submitting content, you grant Yungsten Tech LLC a limited, non-exclusive license to process and store your submitted images and extracted contact data solely to provide the CardCanner service to you.

CardCanner, the CardCanner name and brand, and all software, systems, and services that comprise CardCanner are owned by Yungsten Tech LLC. You may not reproduce, modify, distribute, or create derivative works from any part of CardCanner without our written permission.

12. Disclaimer of Warranties

CardCanner is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement. We do not warrant that the service will be error-free, that OCR results will be accurate, or that enrichment data will be complete or current. Use of the service is at your own risk.

13. Limitation of Liability

To the fullest extent permitted by law, Yungsten Tech LLC's total liability to you for any claims arising from your use of CardCanner is capped at the total fees you have paid to CardCanner in the twelve months preceding the claim. For users on the free tier, the cap is zero dollars ($0.00). In no event will Yungsten Tech LLC be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of business, even if advised of the possibility of such damages.

14. Indemnification

You agree to indemnify, defend, and hold harmless Yungsten Tech LLC, its founders, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of CardCanner, your violation of these Terms of Service, or your violation of any third-party rights.

15. Termination

We may suspend or terminate your access to CardCanner at any time, with or without notice, if we reasonably believe you have violated these Terms of Service or applicable law. You may end your use of the service at any time by replying STOP to opt out of all SMS/MMS messages from CardCanner. Termination does not automatically delete your stored data; to request deletion of your data, reply DELETE or email support@cardcanner.com.

16. Governing Law and Disputes

These Terms of Service are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law provisions.

If you have a dispute with CardCanner, please start by emailing support@cardcanner.com with a description of the issue. We will attempt to resolve the matter informally within a reasonable time. Unresolved disputes will be subject to the exclusive jurisdiction of the courts of the Commonwealth of Massachusetts.

17. Changes to These Terms

We may update these Terms of Service from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and post a banner notice on cardcanner.com. Your continued use of CardCanner after changes take effect constitutes acceptance of the updated terms.
